Statutory Consumer Protection: This policy describes Hozina Technologies' strict commercial refund and cancellation rules. It does not limit or exclude any statutory refund rights, legal remedies for defective or misrepresented products, or other protections provided by applicable law.
1. Purpose and Scope
This Refund and Cancellation Policy explains how Hozina Technologies handles software purchase concerns, subscription cancellation, billing errors, software defects, and cancellation of professional-service engagements.
It applies to direct purchases of Hozina desktop software, subscriptions where offered, and professional services covered by an accepted proposal, Statement of Work (“SOW”), or other written agreement.
Hozina does not provide a general voluntary money-back guarantee unless a specific offer or accepted agreement expressly states otherwise.
Refund eligibility is determined by the applicable purchase terms, the agreed scope of the transaction, applicable law, and any relevant marketplace or payment-platform requirements.
Purchases made through Microsoft Store, another app store, a marketplace, reseller, or third-party payment platform may be subject to that provider's purchase, cancellation, and refund procedure. Hozina will direct customers to the appropriate channel where reasonably necessary.
Nothing in this policy excludes, limits, or waives a consumer right or legal remedy that applicable law does not permit Hozina to exclude or waive.
2. Software Purchases, Refund Eligibility and Subscription Charges
2.1 One-Time Desktop Software Purchases
Hozina does not provide a general voluntary refund merely because a customer changes their mind, decides not to use the Software, purchases a product in error despite the purchase information being clearly disclosed, or later determines that the Software is not needed.
Before purchasing, customers should review the product description, included features, licence restrictions, system requirements, supported Windows versions, known limitations, and any subscription or support terms.
A download, installation, activation, or licence-key delivery does not automatically eliminate a remedy that is required by applicable law. Equally, downloading or activating the Software does not create an automatic voluntary refund entitlement.
If the Software appears to contain a material defect, fails to provide an expressly advertised function, or materially differs from the purchase description, the customer may contact Hozina through the official support channel. Hozina may request reasonable details about the product version, operating environment, error, and steps needed to reproduce the reported issue.
Where appropriate and permitted by law, Hozina may first attempt to resolve the issue through troubleshooting, a correction, a workaround, or a replacement version. This process must not improperly delay or restrict a remedy that applicable law requires.
Where a refund or other remedy is required by applicable law or an expressly accepted purchase agreement, Hozina will honour that requirement.
2.2 Annual Subscriptions
If Hozina offers annual software subscriptions, the purchase information must clearly disclose the subscription price, duration, renewal frequency, automatic-renewal terms where applicable, and cancellation method.
Hozina does not provide a general voluntary refund merely because a customer requests cancellation of an annual subscription or no longer intends to use the Software.
Cancelling an annual subscription ordinarily prevents the next renewal and does not, by itself, create a right to a pro-rata refund of the already-paid subscription period.
Refunds, cancellation rights, or adjustments required by applicable law, the relevant marketplace, the accepted purchase terms, or a verified billing error will be handled accordingly.
Where an applicable law grants a specific withdrawal or cancellation right, the purchase process and this policy must respect that right.
2.3 Monthly Subscriptions
If Hozina offers monthly subscriptions, the purchase information must clearly disclose the price, billing frequency, renewal terms, and cancellation method before the customer completes the purchase.
Hozina does not provide a general voluntary refund merely because a customer decides not to use the subscription or requests cancellation after a valid charge.
Cancelling a monthly subscription ordinarily prevents future renewal charges but does not, by itself, create an entitlement to a refund of the current paid period or unused days.
This does not affect any refund or other remedy required by applicable law, a valid purchase-channel requirement, or an incorrect or duplicate charge.
Hozina will not intentionally continue charging a subscription after an effective cancellation in a manner inconsistent with the accepted purchase terms or applicable law.
2.4 Free Editions, Trials and Promotional Licences
Free editions for which no payment has been made do not create a monetary refund entitlement.
Where a free trial converts to a paid subscription, the purchase flow must clearly disclose the applicable price, start of billing, renewal terms, cancellation method, and any required consent before the customer is charged.
Promotional, discounted, or bundled offers may be subject to specific conditions disclosed before purchase. Such conditions cannot remove a right or remedy that applicable law requires.
A promotional offer does not automatically create a voluntary money-back guarantee unless its terms expressly provide one.
3. Technical Problems, Defects and Product Descriptions
Hozina aims to describe its Software accurately and provide the features and limitations stated in the applicable product documentation.
If a customer encounters a technical problem, Hozina may request reasonable information needed to identify the issue, including the Software version, relevant system information, an error description, and reproducible steps where available.
Where appropriate, Hozina may attempt a correction, supported workaround, or replacement version before considering other available remedies, provided that doing so is consistent with applicable law and the customer's contractual rights.
A technical issue does not automatically create a right to a voluntary refund. Any refund, repair, replacement, price adjustment, cancellation right, or other remedy required under applicable law or the relevant purchase terms will be provided as required.
A product's clearly disclosed feature limitations, supported-platform requirements, or documented compatibility restrictions should be reviewed before purchase. Such disclosures do not excuse a material misrepresentation or a failure to provide a feature expressly promised to the customer.
4. Duplicate Payments, Incorrect Charges and Unauthorized Transactions
Customers who believe that they were charged twice for one transaction, charged an incorrect amount, or charged after an effective cancellation should contact Hozina with the order reference and relevant transaction details.
Hozina will review the transaction records and correct verified billing errors in accordance with applicable law, the payment provider's requirements, and the agreed purchase terms.
Where a payment was not authorized, the customer should promptly notify the relevant payment provider and contact Hozina so that the transaction can be investigated.
Customers must not send full payment-card numbers, passwords, one-time passcodes, private keys, or unnecessary sensitive information through a general support or contact form.
This section does not limit statutory refund rights or prevent a customer from contacting a relevant payment provider or competent authority.
5. Submitting a Request
Customers may submit a software refund, billing-correction, or cancellation request through the published Hozina contact or support channel.
To help Hozina identify and review the transaction, the customer should provide, as applicable:
- Order number or invoice reference.
- Purchase email address.
- Product or service name.
- Purchase or billing date.
- Amount and currency charged.
- A brief explanation of the request.
- Relevant error information or supporting evidence where reasonably necessary.
Hozina may request additional information reasonably needed to verify a transaction or assess a reported technical issue. Requests must remain proportionate to the circumstances and must not require unnecessary sensitive information.
Hozina will review the request under the applicable purchase terms, this policy, marketplace requirements where relevant, and applicable law.
A customer who disagrees with a decision may use the complaints process described in this policy. Nothing in this process removes an applicable statutory remedy or a right to approach a competent authority.
6. Refund Method and Timing
Where Hozina determines that a refund is payable, it will ordinarily be initiated using the original payment method unless an alternative is agreed with the customer or required by the relevant payment provider or applicable law.
Hozina will initiate an approved refund within the period required by applicable law or the relevant purchase-channel rules. Where no mandatory period applies, Hozina aims to initiate an approved refund within ten business days after approval and completion of any reasonably necessary payment verification.
The time required for the funds to appear in the customer's account may depend on the bank, card issuer, payment gateway, or payment service provider.
Hozina will not use payment-provider processing times to avoid a refund obligation or any statutory deadline that applies.
7. Subscription Cancellation and Renewal
If Hozina offers a recurring subscription, the checkout process must disclose its price, billing period, renewal conditions, cancellation method, and applicable subscription restrictions before the customer completes the purchase.
Customers may cancel future renewal through the cancellation method made available for the relevant product or purchase channel.
Unless an accepted offer or applicable law requires otherwise, cancellation prevents future renewal and does not automatically refund the current paid subscription period or unused days.
Hozina will not intentionally continue billing a subscription after an effective cancellation in a manner inconsistent with the accepted purchase terms or applicable law.
Any mandatory withdrawal, cooling-off, cancellation, refund, or renewal right under applicable law or marketplace rules will remain available.
Hozina will retain appropriate records of the relevant purchase and cancellation events in accordance with its documented data-retention practices.
8. Professional Services: General Rules
Website Development, Custom CRM Development, and Workflow Automation & Integrations are professional services whose scope, fees, delivery requirements, dependencies, and timelines vary by project.
Each engagement must be governed by an accepted written proposal, Statement of Work (“SOW”), or services agreement that defines the scope of work, deliverables, milestones, fees, applicable taxes, payment dates, customer responsibilities, acceptance criteria, ownership and licensing, third-party costs, support obligations, and project-cancellation arrangements, as appropriate.
A customer request to cancel or change a project does not automatically entitle the customer to a full refund.
The financial consequences of cancellation are determined by the accepted agreement, the work performed, the milestones completed, approved costs and commitments, any applicable cancellation provision, and mandatory law.
Nothing in this section permits Hozina to retain an amount that it is legally required to refund or to charge a disproportionate cancellation penalty that applicable law does not permit.
9. Cancellation Before Work Begins
A customer may submit a written request to cancel a professional-service engagement before substantive project work begins.
Cancellation does not automatically entitle the customer to a full refund of every amount paid. Hozina will assess the request under the accepted agreement and applicable law, taking into account any work actually performed, agreed and lawfully retainable setup or booking charges, and approved third-party expenses already incurred that cannot reasonably be recovered or cancelled.
Any fee retained for setup, booking, or preparation must be supported by the agreed terms and applicable law and must not constitute an unlawful or disproportionate penalty.
Where the amount paid exceeds the fees and costs lawfully due under the accepted agreement, Hozina will return the remaining refundable balance within the applicable period.
No cancellation provision overrides a statutory right or remedy that cannot lawfully be excluded.
10. Cancellation After Work Has Commenced
If a customer cancels a project after work has commenced, Hozina will determine the amount payable under the accepted SOW, the work actually performed, the milestones completed, the contractually payable value of work in progress, and any approved third-party commitments or other lawful cancellation charges.
The customer remains responsible for fees properly earned and payable for work performed up to the effective cancellation date and for agreed costs or commitments that are lawfully chargeable under the contract.
Any cancellation fee must have been clearly disclosed and agreed in the accepted agreement and must be reasonable and proportionate to the circumstances and applicable law.
Hozina is not required to refund fees properly earned for completed work or accepted milestones merely because the customer changes their mind or decides not to continue the project, subject to any mandatory legal remedy.
Hozina will provide an itemised account of amounts claimed where reasonably appropriate. Any amount paid in excess of the amount lawfully due under the contract will be refunded if required by the agreement or applicable law.
Where appropriate, the parties will agree on the treatment of completed deliverables, paid work in progress, customer materials, account access, credentials, and unfinished work.
Hozina will not charge for future services that will not be performed unless a separately agreed, lawful, reasonable and applicable cancellation charge permits it.
11. Milestones, Reviews and Change Requests
For milestone-based projects, the accepted SOW must identify the relevant milestones, their deliverables, payment triggers, review criteria, and applicable review period.
The customer must provide reasonable feedback, approvals, and required materials within the agreed period, subject to any extension agreed in writing.
Fees for properly completed milestones and work performed remain payable in accordance with the accepted agreement. A customer disagreement, request to change direction, or decision to discontinue the project does not automatically cancel an otherwise valid payment obligation.
Defects or material deviations from expressly agreed acceptance criteria will be handled according to the agreed correction process and any remedies required by applicable law.
New requirements, additional features, expanded scope, or changes to previously approved requirements may require a written change request and additional fees.
Silence or failure to respond will not automatically waive a right that applicable law does not permit the customer to waive.
12. Website Development
Website Development engagements may include design, development, content-management configuration, integrations, deployment, and migration, depending on the accepted SOW.
If a project is cancelled, fees for completed work, work performed, approved non-recoverable third-party costs, and any lawful cancellation charges expressly agreed in the SOW will be assessed under Sections 8–10 and the applicable agreement.
Domain registrations, hosting subscriptions, premium themes, plugins, fonts, stock assets, external APIs, email services, and other third-party purchases are subject to the provider's terms and may not be refundable by that provider.
Hozina will not represent that it can refund costs it did not receive or reverse purchases controlled by a third-party provider. Any amount received by Hozina that must be returned under the accepted agreement or applicable law will be handled accordingly.
Handover, source-code rights, account ownership, and the disposition of completed work are determined by the accepted agreement.
13. Custom CRM Development
Custom CRM engagements are governed by the accepted SOW, which defines the agreed modules, database structure, integrations, migration scope, deliverables, testing requirements, milestone fees, and handover terms.
Where a project is cancelled, Hozina will determine the fees due for completed milestones, work performed, contractually payable work in progress, and approved non-recoverable commitments under Sections 8–10 and the accepted agreement.
Customers do not automatically receive a full refund merely because they change their business requirements, no longer wish to continue, or decide not to deploy the completed work.
The customer remains responsible for lawful authority to provide source data for migration or testing. Hozina will use synthetic or anonymised data where practicable.
Ownership and licensing of bespoke source code, reusable components, third-party libraries, schemas, templates, and other deliverables must be expressly defined in the SOW. Cancellation does not automatically transfer unpaid work or rights that have not been granted under the agreement.
14. Workflow Automation and Integrations
Workflow Automation & Integrations engagements are governed by an accepted SOW identifying the agreed workflows, triggers, actions, integrations, data mappings, hosting arrangements, testing criteria, and support commitments.
If a project is cancelled, the amounts payable will be determined by the accepted agreement, completed work, configured deliverables, work performed, approved third-party commitments, and any lawful cancellation charges expressly agreed in writing.
A customer changing direction or deciding not to use a completed automation does not automatically create an entitlement to a full refund.
Workflow execution depends on the supported capabilities, permissions, and availability of external APIs, platforms, credentials, and infrastructure. Continuous monitoring, guaranteed execution, or uninterrupted third-party service is included only when expressly agreed and operationally supported.
Any mandatory statutory right or remedy remains unaffected.
15. Deliverables and Intellectual Property on Cancellation
The accepted SOW must specify the ownership and permitted-use rights applicable to project deliverables and identify any bespoke deliverables intended to be assigned to the customer.
Unless expressly assigned in the accepted agreement, Hozina retains ownership of its pre-existing software, reusable tools, general-purpose libraries, templates, methods, processes, and know-how.
Subject to applicable payment obligations and the SOW, customers receive only the ownership or licence rights expressly agreed for the relevant deliverables.
Where a project is cancelled, Hozina will identify the deliverables that are complete and paid for and will arrange the applicable handover under the accepted agreement and applicable law.
Unpaid work in progress, reusable Hozina components, and third-party material must not be treated as automatically assigned to the customer.
Hozina cannot transfer ownership of third-party or open-source components where the applicable licence does not permit it.
16. No General Voluntary Refund Guarantee
Hozina does not provide a general voluntary change-of-mind refund guarantee unless a specific written offer or accepted purchase agreement expressly provides one.
Subject to mandatory law and any applicable marketplace rules, a voluntary refund is not ordinarily offered solely because:
- A customer changes their mind after making a valid purchase.
- The customer does not use the purchased Software.
- The customer decides that the Software is no longer needed.
- The customer prefers a different product or workflow.
- The customer does not use all the time remaining on a paid subscription.
- A customer cancels a professional-services project after Hozina has performed work or incurred approved, non-recoverable costs, where those amounts are properly payable under the accepted agreement.
- A customer requests features that were not included in the applicable product description or accepted SOW.
- A third-party purchase or subscription is subject to another provider's refund process.
These circumstances do not automatically eliminate a remedy required by applicable law, a contractual commitment, a material defect or misrepresentation, or a valid billing correction.
Hozina will assess requests according to the relevant transaction, product or service, accepted contractual terms, available evidence, and applicable law. Hozina will not use this section to deny a right that cannot lawfully be excluded.
17. Complaints and Escalation
Customers who disagree with a refund or cancellation decision may request a review through the official complaints channel. The customer should identify the transaction or project, provide the relevant reference, and explain the outcome being requested.
Hozina will review complaints in accordance with the accepted agreement and applicable legal requirements, and will respond within the applicable statutory period or a reasonable period where no specific legal deadline applies.
The complaints process does not prevent a customer from seeking a remedy through a competent authority or forum where that right exists.
18. Privacy and Personal Information
Refund, billing-correction, and cancellation requests require processing order references, contact information, billing details, correspondence, and relevant technical or project records.
Such information is handled strictly in accordance with the Hozina Privacy Policy and applicable data-protection law. Payment gateways and merchant processors may independently handle transaction records under their own regulated terms.
Customers must not submit passwords, secret keys, private credentials, unanonymized customer databases, or unnecessary sensitive personal data as evidence of a refund request.
19. Changes to this Policy
Policy changes apply to purchases and engagements entered into on or after the applicable effective date, subject to the accepted purchase terms and applicable law.
A policy revision does not retrospectively remove a refund promise, contractual right, or other entitlement that arose under an earlier accepted offer or agreement.
The version applicable to a particular transaction will be determined by the accepted purchase terms, transaction records, and applicable law.
Where required by applicable law, Hozina will provide advance notice or obtain affirmative consent before applying a material change to an active ongoing subscription.
20. Governing Law and International Consumer Rights
This policy is governed by and construed in accordance with the laws of India, subject to any mandatory consumer-protection laws or statutory rights that apply to the customer in their country of residence and which cannot lawfully be excluded by contract.
Where a customer purchases digital products or professional services from outside India (including the United Kingdom, European Union, or United States), nothing in this contractual choice of law displaces non-waivable statutory rights, cooling-off remedies, or mandatory consumer-tribunal jurisdictions established under local law.
Disputes that cannot be resolved informally through the complaints process may be submitted to a competent court or statutory dispute-resolution forum having jurisdiction under applicable law.
